I just got back to the post to update it. Even I found through another source that https://www.usvisa-mexico.com/ is the new website for booking visa appointments at mexico consulates!
What makes me wonder though is the fact that tijuana us consulate website and nvars website still point to the old website!?

If we can get the statistics that INS or USCIS is wasting numbers every year on i-485 approvals, i would like to initiate a class action suit.

My sponsoring company changed its? legal name on January 1, 2008 for some restructuring reasons. I got saved, as I?m July 2, 2007 I-485 filer (I ended up completing 6 months after I-485 with filing employer).
Our corporate attorney has advised us that, they would invoke AC21 only if RFE received.
Now, I?m looking else where for a new job ? I plan to invoke AC21 only if RFE is received. However, I?m concerned that my employer may try to revoke I-140 (Note # On Behest of my ?Desi? manager who has pinned me down on several occasions due to my pending GC application)
My question is ? since filing employer no longer exists (legally), would my current employer be able to revoke I-140?
I would appreciate insight from Guru?s on this forum!

I am now thinking of joining an Indian based company and work for same company in US. With this I can always have a base in India and can think of relocate back if need arises. Can anyone tell me the recruiting procedure for some major companies for an applicant like me ? or How to get a recruited to Indian company while being in US..??
My area of expertise is ASP.net 3.5, AJAX, SQL Server., C#. I hold BE in CS and later completed MS in US. I have been working in US from past 5 years after completing MS.
Greatly appreciate any inputs on this?
Interesting queston. Now if you want to look for such a job, you need not really restrict to Indian based companies like TCS , INFY etc... A lot of MNCs have moved IT to India and other countries - A lot of American companies do have offshore development centers in other countries - right from Microsoft, Dell, HP, AMD .................the list will go on and on - a lot of employees relocated to their home countries and some also travel back and forth on business trips ...
Now, if you think that it is in your best intrests to join companies like Infosys, TCS etc.. a lot of those jobs are filled via referrals through existing employees or once in a while they have reqruiting drive across the country

I am using my EAD and working for the company which filed by PERM/I-140/I-485. Currently I am being paid a lot more than the prevailing wage on the PERM so my company has suggested me that they will give the amount listed on the PERM as a salary and the remaining as a check to the company that I own. I have a business in my name but all I did was register the company name; never actively ran the business.
Please share your concerns/opinions about the possibility of above scenario. Do you think taking the salary and B2B expense would cause a problem with the green card process?

I am sending my kid ( US born) with my in-laws to india. Any idea what kind of documents they need to carry ( other than passport, PIO, Birth Certificate)

Do not forget to give grand parents a letter, duly signed by you and your wife that they are taking a minor US citizen, out of the country with parent's consent. I do not have any particular format to give you. Get it notarized, also mention the dates for which he will be outside the country. I had a tough time with Air France few years ago, I was taking my own baby and my wife was not travelling with me. Air France denied me bording because I did not have a wrttien permission from my wife !! It also differs from airline to airline.

If the I-94 was not given a full year's validity due to passport expiring within a year, Is the I-94 still valid after its expiry?
As far as I-94 goes it will expire but since you are already in AOS status, it really does't matter.

This means they have recived your Evidence and the processing has been resume. I donot know if you are victim of A#. Same A# assigned to more than one application(I read it somewhere)

All this big companies as declared will reduce h1b employees in us and will do work remotely - so payroll reduction will be in us and ultimately more loss to us goverment.
if they reduce even 4 out 10 than also 6 people government will get $12k while additional 4 govt. will loose atleast tax and social security other together more than 50k and all the expenses they will do here all those money will go out of the country rather than spending done here, so many side impacts to other industries.

I am looking at this purely for my daughters personal development and no big money is involved but still I dont want USCIS to think she is working even though she is on H4.

Unfortunately, there is not going to be a hard consensus and a good satisfying answer until USCIS comes out and fixes the law. The problem comes from inconsistent USCIS memoranda as to whether an employer who moonlights on EAD has "left" his employer.
AILA has recognized this inconsistency and has provided us, immigration attorneys, with guidance on arguing why the inconsistency should be construed to mean that moonlighting on EAD while preserving H-1B is ok; however, nobody can guarantee that the USCIS will agree with these arguments 100% of the time.

A word of warning: If for any reason the US Consul in Canada denies your visa application, you will not be permitted to return to the US until you go to India and get an H visa.
